The draft law aimed at facilitating access to credit for former cancer patients and those suffering from other illnesses is back in committee following the opinion of the Council of State and its three formal objections.
This is the moment of truth for Bill 8562. Behind this number lies the promise of access to credit for people who have recovered from cancer or suffering from certain diseases, including HIV. Before 2020, these people were faced with a refusal of insurance or an exorbitant premium surcharge when it came to insuring a mortgage loan – effectively making it impossible for them to take out a loan. In 2020, a first solution was offered by the agreement on the right to be forgotten, concluded between the Ministry of Health and the Association of Insurance Companies (Aca). This agreement allows former patients with certain types of cancer not to disclose their illness in the health questionnaire required for outstanding balance insurance on a mortgage loan when purchasing their principal residence or professional premises. And, for patients with certain cancers and pathologies: the obligation to declare it, but with the guarantee that the insurer will not refuse or increase the premium.
