The Court of Justice of the European Union recently confirmed that all legal advice given by lawyers is protected by secrecy. This closes a difficult chapter after a long battle in Luxembourg and on the European level.

How far does a lawyer's professional secrecy extend? In essence, this is the sensitive question that the Court of Justice of the EU had to answer in a case between the Luxembourg tax authorities and the law firm Clifford Chance. Its response was a great relief to the Luxembourg Bar Association, which had taken part in the legal proceedings. "I hope that this ruling puts an end, once and for all, to the discussion whether lawyers' professional secrecy applies only when lawyers represent their clients in court or also when they provide advice", confided the President of the Luxembourg Bar, Albert Moro, to the Lëtzebuerger Journal.
